these general Conditions of sale govern the sale of Atelier St. Wolf on the site:

Atelier St. Loup, SARL with a share capital of 10.000 euros, whose head office is located at 4 rue de la Ville wood, 44100 Nantes, france, registered at R. C. S. Nantes under number B 533 965 182, represented by Mr. Jean-Philippe Marie de Chastenay, acting in the capacity of Manager.

the fact of placing an order implies full acceptance of these general terms and conditions of sale which are accessible at any time on the site and in particular at the time of registration of the order. We invite you to print and keep a copy of these Terms and conditions for future reference. In the absence of proof to the contrary, the data recorded by US constitute proof of the transactions and their date.

the general conditions of sale are the only agreement between the parties and prevail over any other document. They may be modified at any time. The new terms and conditions will be applicable to any order after they are made available on the site.

orders placed on the site are reserved for individuals and companies that are "end buyers" other than for resale. The article review Atelier St.Wolf is strictly forbidden to any buyer who would trade in it professionally.

Attention : you do not have the right to withdraw custom-made products. For standard products, you have 14 clear days from receipt of your order to exercise your right of withdrawal, without penalties and without indication of reasons.

 

ARTICLE 1-two types of ARTICLES are available for sale on our website

-             custom-made items, created and manufactured to your specifications within the limit of the choices available at the time of ordering.

-          a selection of standard items, also called "collection items"; 

offers for items shall be made within the limits of available stocks. Information on the availability of items is provided at the time of placing the order.

our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. In exceptional cases, errors or modifications may occur, in particular in the case of simultaneous orders for the same product by several customers. In the event of a product unavailability after placing your order, we will inform you by email or telephone as soon as possible, offering either to order another item presented on the site in replacement, or to cancel your order. If you choose to cancel your order, you will be refunded immediately if your bank account has been debited.

St. Loup shall not be liable in the event of stock outage or unavailability of the products.

St. Wolf reserves the right to change at any time and without notice the items proposed on the website " http://st-loup.com ".

ARTICLE 2-the unit prices of the ARTICLES and the TOTAL amount of the order

the prices of the articles are all Taxes included (20% at 1 January 2014), excluding transport costs. They are indicated in Euros.

they are modifiable at any time, it being understood that the articles are invoiced on the basis in force at the time of registration of the order.

the total amount of the order you plan to place is indicated on the "summary" screen of your order, and includes the following information:

the order taking is subject to compliance with a procedure whose main phases are as follows:

access to the "summary" screen allowing the addition of the item(s) to your "cart", then validation of the "cart".

PHASE 2 : 5 Step command Validation:

  1. Identification: creating your client account or authentication through an existing client account
  2. Http://www.st-loup.com : information on http://www.st-loup.com billing and delivery

3.      summary:

-      viewing the balance of your order (items ordered, and total amount of the order),

-      fix errors, if any,

-        acceptance of General Conditions of sale,

-      mention of the tentative date of delivery

4.     payment : bank details

5.     Order Confirmation:

-     receipt of a printable order confirmation e-mail message in lieu of an order form, also containing these general terms and conditions, our customer Service contact information, and information regarding the right of withdrawal.

-     receipt of an electronic shipping confirmation message when shipping the order (warning: this electronic message is unanswered).

the invoice will be sent to you by e-mail at the time of sending your order.

we reserve the right not to honour any abnormal or bad faith order, as well as any other legitimate reason.

Important

for custom-made products, you have 24 hours from the time your order is placed to make any changes in the characteristics of the products (colours, choice of metal buckles)...), provided, however, that such changes do not entail any change in price.

ARTICLE 4-payment and retention of Title

the payment of your purchases is made exclusively by credit card when placing your order (Blue Card, Visa, Eurocard / Mastercard, Paypal, American express, Discover, Diners Club).your credit card will be debited no later than six (6) days after placing your order, in the currency of your order.

you make your purchases in complete safety, the confidentiality of the banking information you transmit via the site to an authorized bank is ensured in a secure environment (SSL protocol).

payment card numbers are not kept on our site but on the secure site of a bank.

cross-referencing is performed between the http://st-loup.com bank card and the http://st-loup.com billing.

we remain the owner of the goods sold until full payment of the price, including VAT and transport costs.

ARTICLE 5-delivery-DESTINATION

items offered for sale will only be delivered to Metropolitan France, including the island of Corsica. For all international deliveries, please contact our customer service.

you will be delivered to the address indicated on your order.we do not accept delivery to a post office box or address marked "Postal Sector."

the items are insured by us until delivery.

deliveries are made by Colissimo for France or registered letter R2 (depending on the format).

5.1. Delivery-freight charges

for France, the transport costs are indicated in Step 3 - "RECAPITULATIVE" of the ordering process. They depend on the total amount of your order, and are determined as follows:

5.2. Delivery-time

an indicative delivery date appears in Step 3 "RECAPITULATIVE" of the ordering process. Unless specific time limits are specified during the holiday periods, you will be delivered within a non-contractual time limit of:

-     3 to 8 business days from placing the order for standard items;

if you have not received your order within the time indicated:

-       you received the e-mail confirmation of shipment but did not receive your order within the time indicated:

-           you did not receive the electronic shipping confirmation message but the indicative delivery date on your electronic order confirmation message is past:

-        if you are not delivered within 7 days after the indicative delivery date, for any reason other than force majeure:

the sale can then, if you wish, be resolved (by Registered Letter with advice of receipt, under the conditions provided in article L121-20-3 of the Consumer Code).

You will be able to exercise this right within 60 working days from the expected delivery date.

then You will be refunded all money paid (including the shipping costs paid at the time of the order for the product(s) concerned(s)) within a maximum period of 30 days from the date on which you exercised your right. The return conditions described in the "standard articles" right of withdrawal procedure will then apply.

5.3. Delivery-RECEPTION

5.3.1. PRECAUTIONS

in order to avoid complications when receiving your package, please read the following information carefully:

for all orders delivered in Metropolitan France (including Corsica), Chronopost will deliver the package to the consignee named on the packing slip.

in the event of your absence, and unless it is technically impossible for Chronopost to pick up your parcel, you will receive a transit notice indicating the post office where you must go within 14 days in order to pick up your parcel, along with an identification document.

5.3.2. RESERVED

when you receive your order, always check the condition of your package, the good condition of the item ordered, as well as its conformity to the order.

-        if you notice that your package or item has been damaged, we invite you to specify it on the delivery slip of the carrier, and to contact our customer Service immediately: contact@st-loup.com

in your message, Don't forget to mention the observed damage (wet, punctured, open package, etc.). In all cases, you have a period of three (3) days, not including public holidays, from the receipt of your package to notify the carrier, by extrajudicial Act or registered letter, your possible reservations (article L133-3 of the Commercial Code).

ARTICLE 6-return-right of withdrawal

6.1. Back

if you notice that the item(s) delivered does not correspond to your order confirmation, we invite you to contact our customer Service immediatelycontact@st-loup.com .

the return conditions described in the "standard articles" right of withdrawal procedure will then apply.

6.2. Right of withdrawal

6.2.1. Custom ARTICLES

given the unique and personalized nature of the custom-made item, it cannot be taken over or exchanged in accordance with article L121-20-2 of the Consumer Code:

" the right of withdrawal cannot be exercised, unless the parties have agreed otherwise, for contracts: (...) 3° supply of goods made to the consumer's specifications or clearly personalized ... ".

it follows that you have no right to invoke any right of withdrawal. Therefore, we recommend that you devote the time and attention you need to create your article.

6.2.2. STANDARD ARTICLES

you have fourteen (14) clear days from receipt of your order to exercise your right of withdrawal, under the conditions provided in articles L121-20 and following of the Consumer Code.

to do this, simply contact customer service by email: mailto:contact@st-loup.com">contact@st-loup.com . This one, after validation, will give you a return number to enter on The Return Form.

you must then return your article to us using the pre-filled and pre-paid return label that will be sent to you electronically. Warning: the return label has a validity deadline and must be used within seven (7) days of receipt.

we undertake to refund you the returned item as well as the transportation costs (one-way) related to this item, according to the fee schedule provided in Article 5.1 of this agreement.

the return costs remain at your expense (article L121-20 of the Consumer Code).

as a result, the transportation costs inherent to the return of your item and which we will have advanced, will be deducted from the total amount of your reimbursement, except in case of return for non-compliance with the order, if the indicative delivery date is exceeded under the conditions set out in article 5.2 in fine, or in case of return under legal guarantees.

The reimbursement will be made by crediting the bank account having been used for the payment of the order, as soon as possible and at the latest within thirty days following the date on which you exercised your right (article L121-20-1 of the consumer Code)

in any case, please return your entire article (package insert, accessories)...) in its original state, with the packing, the copy of your invoice and The Return Form duly completed. Returned items that are incomplete, damaged, damaged or soiled will not be accepted.

ARTICLE 7-Exchange

7.1. Custom ARTICLES

due to the unique and personalized nature of the custom-made item, it cannot be exchanged.

7.2. STANDARD ARTICLES

only "standard" items can be exchanged at the Atelier St. Wolf.

items may only be exchanged with other items of equal or greater value.

as a result, no refunds will be made under the exchange procedure. If the item you want to exchange is of a higher value, you will have to pay the difference between the value of this item and the one you ordered.

you have 30 days from receipt of your order to exchange your product.

the items reported should be complete (package insert, accessories)...) in their original state, with the packaging and copy of the invoice. Any returned items that are incomplete, damaged, damaged or damaged will not be exchanged.

ARTICLE 8-guarantees-after-sales SERVICE-responsibility

8.1. Legal guarantees

articles Workshop St. Wolf benefit from the legal guarantee of conformity as well as from the guarantee against hidden defects, in accordance with the legal provisions in force (articles L211-1 to L212-1 of the consumer Code - articles 1641 to 1649 of the Civil Code).

you have 2 years to invoke the guarantees at Atelier St. Wolf. This period runs from the issue of the articles for the legal obligation of conformity (article L211-12 of the Consumer Code), and the discovery of the defect for the guarantee of hidden defects (article 1648 of the Civil Code).

8.2. WARRANTY St. Wolf

the proposed items comply with existing regulations. They benefit from the know-how and quality of the Atelier St. Wolf.

thus they are guaranteed against any manufacturing defect. If such a failure occurred, the Atelier St. Loup undertakes to repair your purchase free of charge, or to exchange it. In case of exchange, defective items will not be returned.

guarantee Atelier St. Wolf does not, of course, cover normal wear and tear, accidental damage, or damage caused by the use of a solvent or abnormal use of the article.

8.3. After sales service

After-Sales Service Atelier St. Loup is responsible for carrying out wear and tear repairs on your items, as well as repairs related to the implementation of legal guarantees and the Atelier St warranty. Wolf.

your article will be sent to our workshops who will make the appropriate decision:

-         in the event of a manufacturing defect found and validated by our workshops, we repair your article free of charge or replace it with a new article of equivalent value.

-         for used items, the repair will be charged. A quote will be offered if the damage is the result of your own act or that of a third party.

-        your article will not be repaired if it is too used. It will then be returned to you as it was.

8.4. Accountability

we are not responsible for the possible color difference "screen/reality", customization choices of the custom item that would not suit, even if it is a gift.

in addition, we will not be held liable or in default for any delay or non-performance resulting from the occurrence of a force majeure event.finally, we would like to draw your attention to the fact that we cannot be held responsible for an order that has been placed by a minor, whether or not the parents have authorized the order.

similarly, we cannot guarantee and affirm:

-      the website http://st-loup.com " is free from any virus, data overwriting programs, Trojan horses or other destructive material ;

-         that the information contained in the site "  http://st-loup.com " are accurate, complete or up-to-date

The website " http://st-loup.com " may contain technical inaccuracies or other defects, we do not warrant the correction of these defects. The website "  http://st-loup.com " and the contents of this site are presented "as is" and "according to availability". We expressly exclude all warranties of any kind, express or implied, and in particular, without this list being exhaustive, all implied warranties of conformity or appropriation of the site "; http://st-loup.com " or its contents to a usual or a specific use, of their quality or of the absence of contravention of any provision thereof.

ARTICLE 9-retention of DOCUMENTS

in accordance with Article L. 134-2 of the French consumer Code, for any order exceeding 120 euros including VAT, we undertake, for a period of 10 consecutive years, to keep the documents relating to the transaction. We guarantee access to it at all times on request (in accordance with decree 2005-137 of 16 February 2005).

In the event of a conflict between the Atelier St. Loup and one of its customers on a transaction carried out on the website, the data recorded by Atelier St. Wolf are considered as irrefutable proof of the content of the transaction.

ARTICLE 10-Information Technology and freedom

your personal data is necessary for the processing of your order and is not at any time intended to be sold, marketed or rented to third parties.

ARTICLE 11-intellectual property

The intellectual property rights on the site and on all elements (trademarks, designs, copyright, domain names...) are the subject of an exclusive right of ownership or use for the benefit of Atelier St. Wolf. Any total or partial reproduction of the site, without the express agreement of Atelier St. Wolf, is prohibited, except for personal and private use, to the exclusion of any commercial purpose.

ARTICLE 12-APPLICABLE law-disputes

these Terms of Use are governed by and construed in accordance with French law without regard to the principles of conflict of laws. These Terms of Use are written in French.

in the event of a dispute, the French courts have exclusive jurisdiction and you agree to accept their exclusive jurisdiction. The Workshop St. Wolf reserves the right to require and obtain injunctions or orders to defend its rights hereunder.
